This document is a template and a starting point provided for transparency during SkillMark's pre-launch period. It has not been reviewed by legal counsel and must be reviewed by a qualified attorney before production launch.

These Terms of Service govern your use of the SkillMark platform and website. Please read them carefully. SkillMark is an AI-native technical assessment platform currently offered on an invite-only basis during a pre-launch period.

1. Acceptance of these terms

By using the platform, taking or administering an assessment, or submitting a waitlist or demo-request form, you accept these Terms of Service. If you do not agree, please do not use the platform.

2. Pre-launch and early-access status

Access to SkillMark is invite-only and provided at our discretion during the pre-launch period. Features, availability, and these terms may change, and access may be modified or withdrawn at any time. The platform is offered for evaluation purposes during this early period.

3. Permitted use

Candidates and organizations may use the platform only for legitimate assessment purposes. You agree not to attempt to circumvent the sandbox or other security controls, reverse-engineer the platform, scrape its data, or otherwise interfere with its operation or the integrity of any assessment.

4. AI assistance and recording

The platform provides an in-assessment AI assistant and records your interactions with it as part of the assessment. By using the platform you consent to this capture. For details on what we record and how we use it, see our Privacy Policy.

5. Intellectual property

SkillMark owns the platform, including its software, design, and analysis technology. You retain rights to the work you submit, subject to our use of that work to run, grade, and analyze your assessment and to provide results to the relevant hiring or internal team.

6. Disclaimers and limitation of liability

During the pre-launch period the service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the maximum extent permitted by law, SkillMark shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, and our total liability is limited to the extent permitted by applicable law.
