Privacy Policy

This document is a template and a starting point provided for transparency during SkillMark's pre-launch period. It has not been reviewed by legal counsel and must be reviewed by a qualified attorney before production launch.

This Privacy Policy explains what personal data SkillMark collects when you take or administer a technical assessment on our platform, why we collect it, how long we keep it, the rights you have over it, and the third parties that help us process it. SkillMark is an AI-native assessment platform: the candidate is the protagonist, and we are deliberately transparent about the unusually detailed picture we build of how each candidate works.

1. Data we collect

During an assessment and across the platform, SkillMark collects and stores the following categories of personal data:

  • Account and contact details. For candidates, your name and email address. If you join our waitlist or request a demo, we also collect your name, email, company, and any message you choose to send. For organization users, we store basic account and team-membership data.
  • Submitted work. The code and documents you write and submit as part of an assessment, including in-progress drafts.
  • A granular activity log. We record nearly every action you take in the assessment workspace. Concrete examples include: code edits; file creation, deletion, and renaming; terminal commands and their output; copy and paste actions; tab switches; test runs and their results; and views of reference materials. Each action is stored with a timestamp.
  • Your full AI chat transcript. Every prompt you send to the in-assessment AI assistant and every response it returns is recorded in full, including which suggestions you accept or reject.
  • A screen recording of your session. We capture a screen recording of the assessment, stored in chunks, so reviewers can replay how the work unfolded.
  • AI-generated analysis and scores. From all of the above we derive an automated analysis, including measures such as prompting quality, your AI-dependency ratio, and prompt archetypes, together with supporting evidence and scores.

2. Why and how we use your data

We use the data described above to run and grade your assessment; to produce the AI-usage analysis that hiring and engineering teams review; to make or support hiring and internal skills decisions; and to operate, secure, and improve the platform. We do not sell your personal data.

3. Data retention

We keep personal data only as long as needed for the purposes described above. For specific retention periods and how to request deletion, see our Data Retention page.

4. Your rights

Depending on your location, you may have rights under laws such as the GDPR and CCPA. Candidates and users may request access to, correction of, or deletion of their personal data, and may object to or restrict certain processing of it. 5. Sub-processors and third parties

We rely on a small set of third-party providers to operate the platform:

  • AI providers (Anthropic and OpenAI). These providers process candidate prompts and AI responses to power the in-assessment assistant and our analysis pipeline.
  • Cloud hosting provider. Stores the data described in this policy on our behalf.
  • Email provider. Used to contact leads and invited users.
